An important book but room for more information in future editions.

This book is a very impartial and fair review of the British law machine. There are, however one or two, admittedly fairly minor omissions that I would like to have seen included including 'contempt of court' and the 'seizure of property' especially the seizure of property that had nothing to do with an alleged crime especially as there appears to be guidelines but no specific laws for the police to follow. I would also liked to have read more about the current grumble that the police spend far too much time trying to achieve a conviction rather than establishing the truth resulting in many miscarriages of justice. This is by far the greatest complaint about the British system that will one day have to be addressed by our law-makers. The secret Family Court system was also barely covered especially where the Social Services witnesses seem to enjoy greater credibility that any other others and where perjury by the SS always goes unpunished. This secrecy prevents wrong-doings by judges and other officials from being exposed as they would be in an open court where proceedings can be reported to the press. The secrecy of courts may be justified in a few cases but 'secret' courts are anathema to most followers of justice.

In summation, this book has filled many gaps in my knowledge and is extremely well put together and written in jargon free English .

THE LAW MACHINE was written by Marcel Berlins and Clare Dyer

The Law Machine was written first and foremost for laymen, individuals and institutions that do not know how the legal system operates. For this reason there is no doubt that everyone is entitled to benefit from this book. But for active lawyers in private or corporate practice it a detailed reminder; for students of law: academic, bar and law society it is an invaluable companion.

The authors were legal correspondents as well as practicing lawyers with varied experiences. Marcel was presenter of the London Weekend Television (LWT) series `The Law Machine' on which documentary the book was produced. The programme explained clearly how the British legal system worked using fictitious motor car accident driven by John Smith knocked down Anne Jones.

The incident had two legal consequences. The criminal prosecution for violating Road Traffic Act at the crown court, and civil suit at the High Court in tort of negligence resulting from breach of duty of care. While the former attracted criminal sanction of imprisonment or fine, the civil suit is/was meant to enable anyone (Anne) get damages for injuries suffered.

Though it was staged however professional lawyers acted as they normally would do in appropriate real life situation. The witnesses and jury were laymen who played similar roles in cases in court. The result was a thorough, clear and comprehensive guide on how a layman can understand and be able to describe the legal system.

Perhaps protocol was treated with levity when sitting judges including the then Lord Chancellor, Lord Hailsham of St Marylebone were interviewd by LWT for this programme. As to whether the British legal system had attained the enviable height expected of it, he said if what was being celeberated is complacency "let us have more of it".

In chapter I the authors discussed how complex legal system could produce justice for all. The establishment of Citizens Advisory Bureaux and legal centres across the country were to enable ordinary Brton recover some compensation as Anne Jones was able to do in the LWT programme, the alternative would have been without any remedy.

The structure of courts and hierarchical significance were discussed by the authors in chapter II. Because of the ignorance of the law and apathy on the part of laymen the court is regarded as a place of drama and uncertainty. They quoted H.L. Mencken, American journalist who described a courtroom as a place where Jesus Christ and Judas Iscariot would be equals, with the betting odds in favour of Judas. The authors used "simplified diagram of English Courts" for illustration.

There is a divided legal profession in Britain. The barristers are lawyers called to the bar who have audience in courts having been enrolled by any of the four Inns. There are on the other hand, solicitors who were trained to draft conveyances and legal documents and obtain briefs from litigants and pass them on to barristers of appropriate expertise to litigate. Litigants are not allowed to brief barristers directly. However, some legislation came into effect to make solicitors have audience in some courts; these solicitors have to display knowledge of High Court proceedings as well as courts where small claims are in issue. All these and more were discussed by the authors in chapter III. The attempt to fuse the two practices was made and law reform failed to take place even though a fused legal profession appeared to be in vogue across the world.

The British court judges are seen as enigma by ordinary Briton. Apart from the classes of judges and their emoluments which the authors displayed and attributed their aloofness, their training is also one of the factors which made it difficult for ordinary Briton to interact with judges. Equally important factor why judges are disconnected from the rest of the society is the role of an umpire they play. They have to be seen to maintain the independence of the institution they represent. Some of their decisions do lead to legal reform. In some cases changes are introduced as a result of their decisions. Part of judicial acitivities include plugging legislative loopholes where there is lacuna; in such rare cases they act as `law makers' even though judges like Lord Denning were criticized for usurping the role of the legislature.

Magistracy is one of the most important structure of British legal system and the authors dicussed this in chapter V. Interestingly there are fewer full-time stipendiary magistrates than unpaid part-time lay magistrates across the country. The rationale, their disqualification, gender balancing, recruitment, training, and the future of lay magistracy were fully discussed by the authors.

Perhaps the criminal justice system is the closest to ordinary individuals than any other. In chapter VI titled `Criminal Process' the authors captures the motor car accident involving John Smith and 25-year old Anne Jones who had just dropped her daughter Katy at school and was knocked down at Laurel Street T-junction.

The authors explained how civil litigation are processed in chapter VII by using Jane's misfortune and examined who should be responsible for the financial losses arising from the accident. There are different types of action, for instance Jane's action is in tort, precisely negligence. It is interesting to note the detailed role of solicitors in Jane's medical history and disposition to earn income, the role of insurance companies to setlle out of court. Unfortunately Anne had to pursue her case to the bitter end after three-year trial with $43,612 as compensation. The chapter ended with the examination of possible reforms looking beyond British jurisdiction.

Divorce proceeding is a major civic litigation in Britain a lot of these proceedings derive from accident claims annually. The authors in chapter VIII estimated that 30,000 of such divorce proceedings yearly came after accident claims. The common thread in all of them is breach of contractor negligence. About 99% of divorce proceedings are undefended. Any defended proceeding would be transferred to High Court where litigation is expensive. An affidavit of evidence and statements is all the Registrar/court requires to proclaim decree nisi which lingers till 6 weeks after which decree absolute is made and parties became free to marry again. Agreement is required between the parties regarding properties and children and an order of court is made accordingly.

The measurement varies with circumstance of the parties and children; no hard and fast rule, however in 1973 Lord Denning's judgment created a precedent of a third of the value of the couple's property, but over the years courts have changed the one-third because of supplementary benefit, increased income, children's maintenance etc of parties.

A layperson�s legal reference that fits as a bedtime reading

If anyone would like to gain a bit of knowledge about the English legal system, the Law Machine would be a perfect read. This book contains materials that are great for dinner party conversations. But, if one were serious about studying ELS at a university setting, then this book would only serve as a starting reference point to one's journey.

About the Author

Albert Einstein (1879 1955) was born in Germany and became an American citizen in 1940. A world-famous theoretical physicist, he was awarded the 1921 Nobel Prize for Physics and is renowned for his Theory of Relativity. In addition to his scientific work, Einstein was an influential humanist who spoke widely about politics, ethics, and social causes. After leaving Europe, Einstein taught at Princeton University. His theories were instrumental in shaping the atomic age.

A great scientist's thoughts about world politics and human society

Einstein: Essays in Humanism (1933-1949)

Albert Einstein was undoubtedly the most famous and revolutionary scientist of the 20th Century, known especially for his special and general theories of relativity, his explanation of the photoelectric effect, his realization that matter could be converted into immense amounts of energy, and his studies in cosmology. But he also had wide-ranging beliefs about politics and social affairs. This book, now available as a Kindle e-book, is a collection of 43 essays and talks that were written for specific occasions. They cover a variety of topics that interested him and in several cases provide useful lessons for our own time.

The first part of the collection, through Essay 20, is concerned with pre- and post-World War II concerns. Einstein, himself a lifelong pacifist, argued for a world government that shared a common pool of armaments and was capable of keeping the peace among fractious national governments. He didn't think that the United Nations, as constituted with a Security Council and permanent-member veto power was going to work in the long run. He recommended a world government where delegates were directly elected by the people on a proportional basis. He recognized the great danger of atomic and nuclear weapons and advocated their strict control by the world government.

In politics, Einstein was a socialist and strongly advocated for such things as a planned economy, free education at all levels, and regulation of capitalist ventures. Today, he would be branded a Marxist, but he disapproved of the Soviet system as being too rigid and corrupt.

He advocated an active role for scientists in society and that science should help to shape government policies. He distrusted the military and spoke of the danger of a military takeover of science in order to use it for war-making purposes. In that, he anticipated Eisenhower's farewell address about the dangers of a military-industrial complex.

The next set of essays are brief descriptions of the scientific achievements of several famous scientists: Newton, Kepler, Marie Curie, Max Planck, and less well-known others. There is also a eulogy to Mahatma Gandi.

The final part of the book is devoted to Jewish issues and Zionism. Although Einstein was not religious in a traditional sense (his beliefs were strongly influenced by Spinoza), he nevertheless supported Zionism, with some misgivings, and was greatly concerned with the future of European Judaism after World War II and the Holocaust. Interestingly, he originally thought that it would be a mistake for Jewish refugees to migrate to Palestine and hoped that the U.S.would see fit to accept them. Then, he was initially opposed to carving out a separate Jewish state in Palestine, but advocated rather naively that Jew and Arab live side by side in peace in a unified Palestine. Later, he modified these views in light of actual developments. He was offered the mostly ceremonial position of President of Israel, but he declined.

Finally, there is an appended biography of Einstein, along with photographs taken at various stages of his life, and a list of acknowledgements.

I found this book to be fascinating to read, both for its historical perspective on problems of his day and for insights into problems that continue into our time. Einstein was a good writer and had a good grasp of English, so I assume (perhaps incorrectly) that he wrote all these essays himself. Occasionally, the writing is somewhat convoluted and not as clear as it could be for a modern reader, but mostly it is quite readable. Those who would like to know how a great scientific mind looked at problems of human society will value this collection of essays.

Footnote, added 6 Sept 2012: Another collection of writings by Einstein, "Out of My Later Years," published about the same time as "Essays in Humanism," contains most but not all of these essays in the four sections titled Public Affairs, Science and Life, Personalities, and My People. "Out of My Later Years" also contains several of Einstein's scientific papers and essays, with some earlier ones translated from German.

A Great Read

I remember as a teen reading a biography of Einstein. I came away with the idea of a person who was clueless in everyday matters and, though I didn't know the term, Asperger's. Reading this collection of writings and speeches I would came to very different conclusion. Einstein cared deeply about people and the world around him. He was very empathetic to the plight of others.

As written in another review, this is divided into broad subject matters. I had to smile at the more political writings since they read like the current Occupiers: the biggest problem with the US is that the majority of the economic power is in the hands of a very small percentage of the people.

I had 2 problems. Since this is a Kindle book I couldn't easily jump back to the bibliography as I started each new essay. I was always curious about the date and circumstance. On a rare occasion it was included in the text, but most of the time I had to guess. The other problem is there was a lot of repetition. The writings came from different sources - he often said pretty much the same thing but aimed at different people.

OK, those are very minor problems. Over all I found the essays fascinating. Einstein was a very good writer and these essays were easy to read yet put a lot of information in their few words. Highly recommended as a way to see a different side of Einstein.

Interesting book...

Have read quite a bit of Einstein but not much about his humanitarian views. Was surprised to see he held some of the views that were presented in this book. Though he was a brilliant scientist, when looking at history and the dark side of man, I think the views he had regarding the world coming together as one under a global government and military are a bit naive. It's one thing for the people of the world to come together using social tools on the Internet, but national governments relinquishing their sovereignty and power is another thing altogether.

This is the first complete survey of the historical pitch standards used by musicians during the last four centuries. Written from a practical perspective and addressed to performers it is the first book to attach frequency values to pitch names and describe where, when, and why various historical pitch levels were used. It surveys a period from the 16th century to the present and focuses on Italy, France, Germany, the northern and southern Netherlands, and the Habsburg Lands, following the developments in the design and function of instruments and how they influenced and were influenced by pitch changes.

The History of Performing Pitch explores the relationships between pitches like Chorton, Cammerton, and Consort-Pitch and what pitch frequencies they represented at various times and places. It also examines what effect pitch differences had on musical notation and choice of key, and discusses practical considerations musicians would have had to make when transposing, especially with regards to the range of singers' voices.

What distinguishes this book from previous pitch studies is that it has been written since the rise of the early music revival within the context of the growing understanding of how "early" instruments work. This development has provided a new source of empirical information not previously available, which allows this book to base its conclusions on a much larger and more relevant sample than has ever been possible before. It refers to the original pitches of some 1,382 historical instruments, including cornetts, Renaissance flutes, traversos, recorders, clarinets, organs, pitchpipes, and automatic instruments from all over Europe and compares this information with music and written texts. While this study avoids categorical answers where historical information is not yet sufficient to justify them, it locates a number of historical pitch levels, discovers several that were previously unnoticed, and disproves several common myths about pitch.

April 14, 1865 Around noon, Booth learns that Lincoln is coming to Ford's Theatre that night. He has eight hours to prepare his plan.
10:15 pm: Booth shoots the president, leaps to the stage, and escapes on a waiting horse.
Secretary of War Edwin Stanton orders the manhunt to begin. April 15 About 4:00 am: Booth seeks treatment for a broken leg at Dr. Samuel Mudd's farm near Beantown, Maryland. Cavalry patrol heads south toward Mudd farm.
Confederate operative Thomas Jones hides Booth in a remote pine thicket for five days, frustrating the manhunters. April 19 Tens of thousands watch the procession to the U.S. Capitol, where President Lincoln lies in state. Wild rumors and stories of false sightings of Booth spread. April 20 Stanton offers a $100,000 reward for the assassins, and threatens death to any citizen who helps them.
After hiding Booth in Maryland, Jones puts him in a rowboat on the Potomac River, bound for Virginia. More than a thousand manhunters are still searching in Maryland. In the dark, Booth rows the wrong way and first ends up back in Maryland. April 20-24 Booth lands in the northern neck of Virginia, and Confederate agents and sympathizers guide him to Port Conway, Virginia. April 24 Booth befriends three Confederate soldiers who help him cross the Rappahannock River to Port Royal and then guide him further southwest to the Garrett farm.
Union troops in Washington receive a report of a Booth sighting. They board a U.S. Navy tug and steam south, right past Booth's hideout at the Garrett farm. April 25 The 16th New York Calvary, realizing their error, turns around and surrounds the Garrett farm after midnight that night. April 26 When Booth refuses to surrender, troops set the barn on fire, and Boston Corbett shoots the assassin. Booth dies a few hours later, at sunrise. April 26-27 Booth's body is brought back to Washington, where it is autopsied, photographed, and buried in a secret grave.

Swanson, a legal scholar with the Cato Institute and a Lincoln historian, knows the assassination inside and out; he's been studying Lincoln since he was a child, and his previous book (with Daniel R. Weinberg), Lincoln's Assassins, was a photographic and archival study of Booth and his co-conspirators. With a surfeit of detail at his disposal, Swanson weaves an absorbing tale in unadorned prose that critics greeted with unanimous approval.

Manhunt: An Exciting Account of Booth's Murder of Lincoln

The most notoriously infamous murder in American history occurred on Good Friday April 14, 1865. President Lincoln was

shot with a derringer by John Wilkes Booth (1838-April 26, 1865) in a murder most foul!Booth came from the most renowned acting family America. He was a superb actor, rake and handsome man who favored Southern Independence, hated the blacks and viewed Lincoln as a tyrant. Booth killed Lincoln after several earlier kidnap schemes went awry.

As an avid Civil War buff and student of the Lincoln assassination this is one of the two best books on the murder of the railspliter. The other great book on this topic is Edward Steers.Jr's classic "Blood On the Moon."

This book is not as dry as Steers book and could serve as the basis of a motion picture or better yet mini-series on the horrific event.

In great detail Swann tells us what really happened on the 12 day flight by Booth and his fellow conspirator David Herold on their flight to the Garrett family barn near Port Royal, Va. where Booth was shot to death by Sergeant Boston Corbett and

Herold was captured. (Herold along with George Atzerdot; Mary

Surratt and Lewis Powell would die on the scaffold on July 7, 1865.

Powell had sought to kill Secretary of State Seward in his bed where he was recovering from a painful carriage accident. He failed. George Atzerodt failed to even try to assassinate Vice President Andrew Johnson living in the Kirkwood Hotel.

If you want to excite a young person in American history this is a wonderful place to begin. Swann can write well and simply about complex events regarding the assassination. Finishing this book I have a new respect for Secretary of War Edwin Stanton who led the manhunt for the killers.

The book has many period illustrations, letters from the participants in the ghoulish search and a final chapter alerting us to the fate of the chief characters in this American Tragedy.

I stayed up until 1 AM last night reading this excellent and

exciting book. Very well recommended!

Compelling treatment, with some new information...

I've read several accounts of the death of Lincoln and its aftermath over the past 50 years, but not any of the recent publications, until picking this off the library shelf last week. I enjoyed it immensely. The flaws mentioned by prior reviewers are probably justified, but if, like me, the weakest part of your Lincoln lore was the escape and capture of Booth, this is a sufficient remedy for that gap. It is detailed enough, with interesting notes, yet it does read like a novel. One comes to feel sorry for Booth's suffering on his 12-day run, while not excusing his foolish crime, which did the South more harm than good. More photos would have been nice, including some modern views of the Maryland/Virginia locations. I've been to Ford's Theater and the Peterson House, and Swanson's treatment of those locales is nicely done. Although billed as the story of the manhunt, Lincoln does not die until page 139 of a nearly 400-page text, so the actual killing, and the simultaneous attack on Secretary of State Seward, are depicted in more-than-adequate detail.

I have been reading about the Lincoln assassination for over 45 years and this is the best book to date. It is riviting, filled with heretofore unrevealed details and updates. A wonderful read! Mr Swanson has done a lot of research and has woven a thrilling story...yet it is all true! He could not make these things up! Great book. Thanks
